1. Scope and Seller Information

These Terms and Conditions of Sale (“Sales Terms”) apply to all offers and sales of goods through www.sunjoyonline.eu (“Sunjoy Shop”) by:

Only these Terms apply. Customer conditions are not accepted even if SunWay does not expressly object. Customers may be consumers or businesses as defined by German law. You must be at least 18 years old to place an order.

2. Contract Language and Storage

The webshop operates in German and English. The contract language is German; translations serve information only. The Terms are available before checkout and sent again with the shipping confirmation.

3. Conclusion of Contract

Product listings are non-binding.
Placing items in the cart and clicking “Pay Now” constitutes a binding purchase offer.
You receive an automated confirmation email (not yet acceptance).
The contract becomes binding when you receive a shipping confirmation email or when the goods are handed over to you.

4. Customer Obligations and Account Use

You must provide complete and correct information. Inaccurate details are your responsibility.
Content (e.g., product reviews) you post must not infringe third-party rights; you grant SunWay non-exclusive, unlimited usage rights to publish or edit such content.
Manipulation or technical interference with the site is prohibited and may lead to account suspension. Each customer may hold only one active account.

5. Delivery Conditions, Compliance, Force Majeure

SunWay ships within Germany, France, and Austria.
Products comply with German and Austrian regulations. No liability applies if they conflict with other national laws.

Delivery is curbside only. Risk passes to you upon receipt.

If goods are unavailable due to supplier failure (through no fault of SunWay), SunWay may cancel the order and refund any payment.

During force majeure (e.g., war, pandemics, natural disasters, official restrictions), delivery obligations are suspended for up to six months. After that period, you may withdraw from the contract.

For business customers: if delivery fails due to your fault (wrong address, absence), you bear the extra shipping costs and possible storage fees (0.5 % per day of net value).

6. Prices, Payment, and Invoicing

All consumer prices include VAT. Shipping costs are shown separately.
We accept credit cards, SEPA debit, PayPal, invoice (Billpay), and advance payment, subject to availability at checkout.
Payments are due immediately; for invoices, within 14 days of receipt.
You agree to receive invoices electronically. Objections must be raised within 7 days of receipt.

7. Promotional Vouchers

Promotional vouchers (issued free during campaigns) can be used only once within their validity period and may be subject to minimum order values or product restrictions. They cannot be exchanged for cash, combined with other vouchers, or used after order completion. Refunds do not re-credit expired vouchers.

8. Gift Vouchers

Gift vouchers (purchased for value) can be used to buy any product on the Sunjoy Shop except further gift vouchers or delivery/assembly services. Unused balances remain valid; no cash redemption.

9. Retention of Title

All goods remain the property of SunWay until paid in full.

10. Warranty and Liability

Consumers have the statutory two-year warranty under German law.

For business customers:

  • Visible defects must be reported within 24 hours; hidden defects within two working days after discovery.

  • SunWay may choose to repair or replace. After two failed attempts, you may request a price reduction or withdraw.

  • Claims expire after 12 months from delivery unless law requires longer.

SunWay is liable only for intent or gross negligence, for breach of essential contractual duties, or for injury to life, body, or health.
Liability under the Product Liability Act and Art. 82 GDPR remains unaffected.

11. Data Protection

All personal data collected for ordering and delivery are processed in accordance with applicable data-protection laws and our Privacy Policy.

12. Right of Withdrawal (Consumers)

Consumers may withdraw from the contract within 14 days without giving reasons.

You may use the standard withdrawal form provided.
If you withdraw, all payments, including standard shipping costs will be refunded within 14 days using the same payment method. We may withhold the refund until we receive the returned goods.
You must return the goods within 14 days after notice.

SunWay covers return shipping within Germany only when using our prepaid label; otherwise, you bear the cost.
You are liable for any loss in value resulting from unnecessary handling.

13. Voluntary 30-Day Return Policy

In addition to the statutory right of withdrawal, consumers have a voluntary 30-day return right from receipt of goods.
Items must be in original packaging, unused, and undamaged.
Freight items require prior email notice to shop@sunjoygroup.com for arranged pickup.
Returns not meeting these conditions may be refused or subject to value deduction.
This voluntary policy does not affect your statutory rights.

14. Refunds

Refunds are made to the same payment method used:

  • Invoice / prepayment → same bank account

  • PayPal / credit card → same account

  • Gift voucher payments → credited to voucher balance.

16. Online Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR).
SunWay Europe GmbH does not participate in consumer arbitration procedures.

17. Governing Law and Jurisdiction

Contracts are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a business entity or public law corporation, the exclusive jurisdiction is Berlin, Germany.
Mandatory consumer jurisdiction remains unaffected.

18. Severability Clause

If any provision is or becomes invalid, the remaining clauses remain in force, unless continuation would impose unreasonable hardship on either party.
